The present Master thesis deals with the legally important issues related to matrimonial property regime. Specifically, in this thesis, here is discussed the basis of origin for the matrimonial property regime, the property rights and obligations of spouses, in the current legislation and historical context, the rule of dividing the common property of spouses and the peculiarities associated with it.
In the thesis is discussed the current problematic issues of society, such as the spouses ownership on the real estate, which is acquired during marriage, the rule of dividing this ownership and the legal nature of the estate, which is acquired by the non-registered spouses, during in their lifetime.
Issues, presented in this thesis are discussed in the example of Georgian legislation and court practice. Also, the examples of other countries have been used in relation to individual issues.
In addition, the thesis deal with possible ways of solving the problematic issues discussed in it.
