Abstract
In legal literature trial in absentia is called ,, summary judgment”. It is a decision, made against the person, who is not physically present and tendered evidence is not studied by the court.
Default judgment is a very important tool and can avoid retrial, chich is often unfairly attempted by litigants. Default judgment is one of the most considerable and disputed institutions of Civil Procedure Code. Accordingly, is often a point of i ssue. Thus, my case study represents the legal basis of default judgment and analysis of case law, considered in Civil Procedure Code of Georgia, chapter XXVI.
When the default judgment is possible or inadmissible and why already passed judgment has to be recalled. In thos work it is indicated theoretical, as well as practical analysis of default judgment and also given a lot of examples of judicial practice of all three instaces.
