იპოთეკარის მოთხოვნის დაკმაყოფილების სამართლებრივი გზები

Master’s thesis concerns to legal ways of fulfillment mortgagee’s requirement. This issue is considerable because not only in Georgia but in another countries too there is an important problem to provide mortgage’s reliable form, which is compliance in economy and protection the rights of mortgages.
This work defines the problems related to above mentioned issue.
The main purpose of this research are legal ways of fulfillment of mortgagee’s requirement, analysis the selling form of the subject of mortgages, which is regulated by private law norms and realization-related flows, which we can see in the civil code of Georgia and enforcement law of Georgia.
By means of normative methods here is analysed the station of mortgage norms, mortgages as institution importance in Georgian legislation, and the role of mortgagee. Also how legislation regulates the fulfillment of mortgagees requirements with legal ways, throughout mortgage regulatory normative acts it is defined the flaws of mortgage’s institution.
In the research process it is partly used comparative method. Parallels are rinsing in European private law codification, the mortgage Institute.
