ჩხრეკა და ამოღება, მათი პროცესუალური დახასიათება

Abstract

The given work touches on procedural character of search and wisdraw. It consists of an introduction, three chapters, seven subtitles and a conclusion. The work enclosed with the list of appled literature and the appendix, that represents a diagram on statistics of search and withdraw in the years 2017-2018. In the whole the theme contains 65 printed sheets. The first chapter of the work deals with the brief rewiew of the applied literature. The main part of the theme is given in the second chapter, where the following questions are discussed in detail. Namely: the essence, goals and tasks of search and withdraw, formal as well as law principles of search and withdraw and analysis of the rules and the types of the mentioned investigating activites. For obviousness the practical examples are applied while discussing each question. In the second chapter we find a research/analysis the goal of which is to illustrate what imprediment are to be coped with by investigating agencies while following the rules of withdraw. The deficiency connected with search is discussed in the given work. The third chapter represents the outcomings of the research.

სამაგისტრო ნაშრომი ეხება ჩხრეკა/ამოღების პროცესუალურ დახასიათებას. იგი შედგება შესავლის, სამი თავის, შვიდი ქვეთავისა და დასკვნისაგან. ნაშრომს ერთვის გამოყენებული ლიტერატურის ნუსხა და დანართი - 2017-2018 წლის სტატისტიკა ჩხრეკა-ამოღების თაობაზე დიაგრამის სახით. მთლიანობაში თემა მოიცავს თაბახზე ნაბეჭდ 65 გვერდს. ნაშრომის პირველ თავში მოკლედ არის მიმოხილული ის ლიტერატურა, რომელიც გამოყენებულია თემაში. მეორე თავში მოცემულია თემის ძირითადი ნაწილი, სადაც დეტალურად არის განხილული ისეთი საკითხები, როგორიცაა: ჩხრეკისა და ამოღების არსი, მიზნები და ამოცანები, ასევე მიმოხილულია ჩხრეკის და ამოღების როგორც ფორმალური, ისე სამართლებრვი საფუძვლები. გაანალიზებულია აღნიშნული საგამოძიებო მოქმედებების წესები და სახეები. თემის უკეთ წარმოსაჩენად, თითოეული საკითხის მიმოხილვისას გამოყენებულია პრაქტიკული მაგლითები. მეორე თავში ასევე შევხვდებთ კვლევას, რომლის მიზანია უკეთ დაგვანახოს რა დაბრკოლებების წინაშე დგას საგამოძიებო ორგანოები ამოღების წესის დაცვის დროს. ნაშრომში განხილულია ჩხრეკასთან დაკავშირებული ხარვეზი. მესამე თავს წარმოადგენს კვლევის შედეგები.
