Master’s work is about criminological and criminal analyse of criminal personality. The present paper discusses in detail the theoretical and methodological issues of the study of the offender, in particular, the essence of the offender and the problem of the uncertainty of his definition in criminal law. The paper also reviews the personality of the offender as a carrier of the causes of criminal behavior, more specifically, the relationship between social and biological motives, motivational factors and the problem of diversity of the typology of the offender. The present paper includes an analysis of the conformity of the offender's personality with respect to punishment. Given that the legislature obliges the court to take into account the identity of the offender when making a summary decision, and its investigation is the responsibility of the prosecution as part of an objective and thorough investigation, the problem is presented in terms of the uncertainty of a specific case study methodology.
The paper also discusses the obligation of a strictly individual approach to juvenile delinquency, within which the methodology of the study of the person is defined and the relevant report is filled out by the social worker.
In addition, the paper reviews the issue of examining the identity of the offenders at the stage of parole and, in addition, discusses the novelty of the current year, according to which a new program has been created for convicts for life imprisonment, Within which for at least two years a well-defined methodology will examine the personality of the offender and finally complete a summary report.
The study revealed that it is necessary to refine the approaches to the study of adult offenders at different stages of criminal law, which requires the introduction of a similar model of probation systems in European countries reviewed in the paper in Georgia. Since all people should be valued by the state, regardless of age or other marks, and such discrimination should not occur in the administration of justice.
