The issue of commission of, indirect commission of and complicity in crime are so closely linked to each other in criminal law that they have a number of common features, although there is a difference as well which is discussed in details in this paper. The mentioned institutions are not new in criminal law; there are a lot of references on these issues in Georgian, as well as in Russian and other languages. However, we still encounter some difficulties in case law when it comes to the legal assessment of commission of, indirect commission of and complicity in crime.
This paper addresses the issues of commission of, indirect commission of and complicity in crime.
While working on this paper, we used methods of dialectical research, comparative research of statutory provisions, generalisation of case law, analysis and synthesis, research of logical thinking, etc.
Monographs, scientific-research works and other scientific references were used in the preparation of this paper.
We hope that the regulations we have developed will facilitate to improve this institution.
