ტერორიზმის თანამედროვე ტენდეციები და მისი კრიმინოლოგიური ასპექტები

Abstract

წინამდებარე ნაშრომში განხილულია ტერორიზმის თანამედროვე ტენდეციები და მისი კრიმინოლოგიური ასპექტები. მრავალი წლებია ტერორიზმი უდიდეს საფრთხეს უქმნის სახელმწიფოების დემოკრატიას. ის არის ძალადობის სისტემური გამოყენების იარაღი, რომელიც მოსახლეობაში მუდმივ შიშის ნერგავს, ახდენს პოლიტიკურ კლიმატის ცვლილებებს და ხელყოფს ადამიანთა სიცოცხლეს. ნაშრომის პირველი თავი ეხება ლიტერატურის მიმოხილვას. მეორე თავი ტერორიზმის განვითარების გნოსეოლოგიური ფესვებს სადაც განხილულია: ტერორიზმის განვითარების თავისებურებანი დროსთან მიმართებით, ამ ქვეთავში გამოყოფილია ოთხი მნიშვნელოვანი პერიოდი და აღწერიალია ტერორიზმის როგორი სახის გამოვლინებები იყო, ჩვენი წელთაღრიცვიდან მოყოლებული დღემდე. შემდეგ ქვეთავებია ტერორიზმის დეფინიცია, ტერორიზმის წარმოშობის მიზეზები, ფორმები და სახეები, სადაც სხვადასხვა მეცნიერების, იურისტებისა თუ პრეფესორების მოსაზრებებისა და დასკვნების შეჯამებით, გამოყოფილია ტერორიზმის სხვადახვა დაჯგუფებები, განხილულია მათი სახეების ფორმები და მოქმედბები. აღნიშნული თავი გვეხმარება რაც შეიძლება სრულყოფილად დავინახოთ და გავერკვიოთ, თუ როგორი დანაშაულია ტერორიზმი, რა საფრთხეებს შეიცავს ის და რა ხერხებით ებრძვიან მას. მესამე თავი ეხება თანამედროვე ტერორიზმის ტენდეციებს და მის პრევენციასთან დაკავშირებულ პრობლემებს. თანამედროვე ტენდეციებთან მიმართებით ძირითად განხილულია 2020 წლის მსოფლიო მდგომარეობა ტერორიზმთან დაკავშირებით, რომელიც კოვიდ პანდემიასთან თანხვედრაში მიმდინარეობდა. გამოყოფილი და განხილულია ყველაზე მწვავე თანამედროვე ტერორისტული შემთხვევები, რომლებიც ამ წლებში მსოფლიოს თავი დაამახსოვრა საინტერესო და ამოუხსნელი შემთხვევებით. მაგრამ, ყველაზე საინტერესო ის იყო, რომ ამ წლებში, გასული წლებისგან განსხვავებით, მთლიანად ტერორისტული აქტივობის ანალიზი კორონავირუსის გავრცელების ჭრილში ხდებოდა. სწორედ ამიტომ, ეს თავი გვაძლევს საშუალებას დავინახოთ დღევანდელი მსოფლიოს მდგომარეობა ტერორიზმთან მიმართებაში. რაც შეეხება ტერორიზმის პრევენციასთან დაკავშირებულ ასპექტებს ამ თავში განხილულია ტერორიზმის კრიმინოლოგიური თავისებურებანი და მის პრევენციასთან დაკავშირებული სამართლებრივი ასპექტები. მოყვანილია საქართველოსა და სხვადსხვა ქვეყნის მაგალითები, თუ რა ხერხებით ებრძვიან ტერორიზმს და რა პრევენციულ ზომებს მიმართავენ ესა თუ ის სახელმწიფოები ამ პრობლემის გადასაჭრელად. ეს თავი ნათლად გვანახებს იმ ეფექტურ გზებს რითაც შესაძლებელია ეფექტურად ვებრძოლოდ ამ დანაშაულს - ტერორიზმს. ნაშრომი მოიცავს სარჩევს, ანოტაციას, შესავალს, გამოყენებული ლიტერატურის მიმოხილვას, ძირითად თემას (რომელიც დაყოფილია თავებად და ქვეთავებად), დასკვნას და გამოყენებული ლიტერატურის ჩამონათვალს.

The following text describes modern trends in terrorism and its criminological aspects. For many years, terrorism has posed the greatest threat to the democracy of states. It is a weapon of systemic use of violence that instills constant fear in the population, changes the political climate and violates human life. The first chapter of the paper deals with a review of the literature. The second chapter discusses the epistemological roots of the development of terrorism: Peculiarities of the development of terrorism over time, this subsection distinguishes four important periods and describes the manifestations of terrorism from our era to the present. The following are the definitions of terrorism, the causes, forms and types of terrorism, where by summarizing the opinions and conclusions of various scientists, lawyers or professors, different groups of terrorism are separated, their forms and actions are discussed. This chapter helps us to see as fully as possible what the crime of terrorism is, what dangers are and how to fight it. The third chapter deals with the trends of modern terrorism and the problems associated with its prevention. In relation to modern trends, the main discussion is the world situation in 2020 in relation to terrorism, which coincided with the Covid Pandemic. Isolated and discussed the most acute modern terrorist cases that the world has remembered in recent years with interesting and unexplained cases. But, the most interesting thing was that in these years, unlike in previous years, the whole analysis of terrorist activity was done in the context of the spread of coronavirus. That is why this chapter allows us to see the state of the world today in relation to terrorism. As for the aspects related to the prevention of terrorism, this chapter discusses the criminological features of terrorism and the legal aspects related to its prevention. There are examples of Georgia and different countries, how they fight terrorism and what preventive measures are taken by this or that state to solve this problem. This chapter clearly shows the effective ways in which we can effectively fight this crime - terrorism. The paper includes a table of contents, an annotation, an introduction, a review of the literature used, the main topic (which is divided into chapters and subsections), a conclusion and a list of the literature used.
