The object of study and research of the work for master's degree is the legal institution of self-defense, the circumstance excluding unlawfulness. It is shown, how important is the combination of the characteristic features of the objective and subjective side for the legitimacy of self-defense. The work focuses on the fundamental and problematic issues related to self-defense, which is the causative factor of opinion differences.
The structure of self-defense and the conditions of its lawfulness are discussed in the conducted study. Due to its special importance, great attention is paid to the scope of the self-defense and associated issues with it. One of the main areas of study in the work is represented the provocation problem of self-defense, which due to its specific nature has not been yet perfectly developed and studied. The provocation of self-defense has different forms of manifestation and accordingly, the study provides the ways of correct assessment of provocation types of self-defense.
