Abstract

We have the opportunity to do this we met everything in advance, well prepared and group fully adopts the institution of the lawsuit to Georgian law. სარჩელის სასამართლოში შეტანა ადამიანის დარღვეული თუ სადავოდ ქცეული უფლების აღდგენის სამართლებრივი გზაა. ყოველ ადამიანს აქვს უფლება დაიცვას საკუთარი უფლებები სამართლებრივი გზით. ნაშრომში განხილულია როგორც ზოგადად სარჩელის, ასევე ჯგუფური სარჩელის წარმოშობისა და განვითარების ისტორია, მისი სახეები. ნაშრომში ნაჩვენებია ჯგუფური სარჩელის დღესმოქმედი სახეები მსოფლიოს სხვადასხვა ქვეყნებში და მისი გამოყენების სამართლებრივი გზები. ჯგუფური სარჩელის ინსტიტუტი ჩვენს ქვეყანაში ჯერჯერობით კანონმდებლობით არ წესრიგდება, თუმცა სავარაუდოა, რომ ახლო მომავალში დღის წესრიგში დადგება ამ ინსტიტუტის შემოღებისა და დანერგვის აუცილებლობა ქართულ იურისპრუდენციაში. ჩვენ გვაქვს შესაძლებლობა, ამ ყველაფერს წინასწარ, კარგად მომზადებულები შევხვდეთ და ჯგუფური სარჩელის ინსტიტუტი სრულად მოვარგოთ ქართულ სამართალს. ჯგუფური სარჩელი ამერიკულ სამართალს უკავშირდება და სწორედ ამერიკა ითვლება ჯგუფური სარჩელის სამშობლოდ, მიუხედავად იმისა, რომ ეს ინსტიტუტი თავიდან ინგლისში წარმოიშვა. ჯგუფურ სარჩელს შეუძლია დროისა და ფინანსების მკვეთრი დაზოგვა. როდესაც ადამიანთა ჯგუფს ერთი და იგივე უფლება აქვს დარღვეული, მათ შეუძლიათ შეიტანონ ერთი სარჩელი სასამართლოში და ამით მოიგონ დრო, დაზოგონ ხარჯები, თავიდან აირიდონ სხვადასხვა გადაწყვეტილების გამოტანა ერთი და იმავე საქმეზე და ხელი შეუწყონ სწორი სასამართლო პრაქტიკის დამკვიდრებას.
