The master's thesis is deals to the legal analysis of the crimes under the Articles of 128 and 129 of the Criminal Code of Georgia - Abandoning in distress and Refusal to assist. The paper consists - introduction, three chapters and conclusion. The list of references is indicated at the end of the paper. First chapter provides brief review of the literature used in the process of working and their importance for the perfect processing of the topic. Second chapter deals with the main part of the research, where the actuality and structure of the topic are are discussed. The main part consists of nine subsections. They cover the following issues: the essence of committing a crime by inaction; Separating action and inaction from each other; Inaction by action; Legal guarantor function; Issues of crime preparation and attempted real and mixed inaction; the intent to commit an intentional crime; Characterization of abandonment and non-assistance components according to objective and subjective signs. Third chapter devoted to the results of the research, where the author's attitude towards the problematic issues related to the topic.
