Abstract
In the work is discussed peculiarities of the legal nature of the bank guarantee as an independent means of supply of the request. The actuality of its use, which is conditioned by the non-formal character of the bank guarantee as a means of supply of the request and the possibility of independence from the main obligation. It is analyzed the legislative norms, which regulate this institute in the Civil Code of Georgia. There are outlined lacunas, which are found in the content of some norm in relation of the bank guarantee. The ways of eliminating these lacunas are proposed. It is discussed the essence of the bank guarantee, its independent nature, how independent is the bank guarantee from basic obligation according to the mechanism of payment of the warranty amount, during the conditional and unconditional bank guarantee.
