The work deals with one of the principles of criminal law – realization problems of the adversarial principle at the stage of investigation.
Adversary, as one of the basic principles of criminal law, is a novation in Georgian legislation. For the first time in the text of the law is found in the fifteenth article of the 1998 Criminal Procedure Code. The New Criminal Procedure Code adopted on 9 October 2009 has been refurbished by the Criminal Procedure Adversarial System. The prosecution and defense side has been granted the opportunity to conduct an investigation independently, to find out the evidences and submit them to the court.
The novelty generated a need to develop and study many new issues, since the essence of the principle is on competition between the parties and requires that the parties be in equal conditions not only theoretically but also as factual. In order to effectively implement the principle, the parties are not obliged to encounter evidence when it comes to evidences.
