Hypothetical nature of the purchase with the right of the redemption agreement

Purchase with the right of redemption agreement with its legal nature resembles a loan and mortgage agreement, which gives the opportunity, to cover one transaction with another transaction, the problem arises when the redemption agreement serves the provision of credit, which may be allowable in case if the content of the agreement does not aim to avoid the rule of law.
The problem towards hypothetical nature of the purchase with the right of redemption agreement worsened since the series of legislative changes had been carried out in loan and mortgage agreement regulations, after which the sides instead of the loan and mortgage agreements have begun to make the purchase with the right of the redemption agreement with avoiding the law.
Based on abovementioned, my goal in the Master's Thesis is to find all the problems related to the hypocritical nature of the Redemption Agreement compared to the doctrine, judicial practice, and foreign legislation on the basis of legal analysis and draw the relevant ways of eliminating the problem as a conclusion.
