Abstract
The LL.M. diploma thesis by Victoria-Sophio Khutsishvili, LL.B. on "The Necessity of
Vertical Unbundling in the Electricity Sector" presented to award her with LL.M. degree.
The work responds to Georgia's obligations under the EU legislation in the field of energy.
The study reviews European mechanisms for promoting transparency and fair
competition in the field of energy and Georgia's energy system in terms of fulfilling its
obligations as well. The theoretical material and legal documents discussed and processed
in the paper are analyzed by the European legislative prism, the legislative shortcomings
of Georgia are identified and recommendations to avoid the monopoly and the anticompetition
action
at
the
National
Energy
markets
are developed.
The European Directives and Regulations, which define the protection of consumer rights
in the light of the existence of transparency of state policy, and European standards are
compared with the state policy of Georgia's policy, supply, networking and energy
storage.
Finally, the diploma work and the legal recommendations will serve the current stage of
the reform of the Georgian Energy System, the efficiency of fulfillment of Georgia's
obligations so that the energy consumers know the market condition, make free choices
and better protect their interests. The diploma work has been prepared to obtain a
Master's Degree in Law.
