Abstract
Mediation in one of the conflict resolution alternatives, which active use in Georgia has begun recently. The main feature of mediation is that it provides a voluntary, confidential and interest-based procedure. Interests can be personal, financial, social and economic. Consequently, the freedom of the mediation process indicates its informal nature, where the parties have the opportunity to interupt the dispute at their own will. Unlike the cout proceedings, the main advantage of the mediation, is that it is financially cheap, as well as, it is time saving procedure. Under these circumstances, the development of the mediation helps not only the parties to resolve the dispute quickly and efficiently, but also helps the court to alleviate many cases. Thus, promoting the development of mediation may the considered as a state’s obligation.
The aim of my work paper is to introduce you the basic principles and ethical standards that characterize mediation, which are mandatory for conducting the mediation process and for the mediator either. The paper also discusses the mediator's ethical responsibility, standards of conducting the process, duties and responsibilities.
The second chapter begins with a brief historical overview of mediation development and concludes with a modern significance of mediation. The first subsection discusses both, as well as, Georgia and the world example - starting with the Sumerian era and ending with the ideology of Ilia Chavchavadze agreeing to end the dispute with negotitaiton...
