სამოხელეო დანაშაულის (სსკ-ის 332-333 მუხლები) მტკიცებულებათა სტანდარტის სამართლებრივი ანალიზი ადამიანის უფლებათა ევროპულ სასამართლოსა და ქართულ მართლმსაჯულებაში

The dissertation work refers to the main cornerstone of the criminal process – evidence and its standards concerning the official misconduct. Within the scope of the work, the study was conducted on official misconducts for the first time, which has covered both the monuments of secular and religious law of Georgia and other countries of the world. The particular attention was paid to the recordings of ancient law monuments, which were regulating the principles of penalization of criminal acts such as abusing of official powers and exceeding official powers. Also, these recordings were defining the types of sentences and the size of penalty for abovementioned crimes. The work analyzes the concept and the importance of an official misconduct according to different phases of human development, on examples of different countries from Europe and Asia. Author also provides the specific analyses, classifications and describes methods of combatting on the basis of existing historical sources. Historical-legal research has been held concerning the crime evidence and therefore analyzes were made on the minimum standards of the totality of evidence, based on which judges of different countries delivered justice.
