Abstract
The thesis deals with the tactical and psychological features of interrogating witnesses, highlights drawbacks of investigation and the court, tries to present its weak sides more clearly. Thus, for the first time in Georgia, we have carried out tactical and psychological means of interrogating witnesses, which were previously considered separately by psychologists and criminologists, we have worked out practical advice to increase the effectiveness of the investigative activity. Obtaining information from witnesses or confession from offenders greatly depends on organizing and conducting the interrogation process correctly. If interrogation goes wrong, it may have negative results for all sides of the interrogation. These sides are witnesses, victims, investigators, the police and other forces who have the right to participate in the interrogation process.
According to the above, we have worked out the differentiated methodology of interrogation, which is based on the achievements of modern psychology and criminology, as well as an existing positive experience.
Therefore, the present paper is distinguished with its actuality and is the first attempt to study the problem of interrogation and to establish a modern interrogation system in Georgian criminal law and criminology.
One of the problematic issues is the process of formulating the evidence obtained during interrogating witnesses and victims, which is separately discussed by psychologists and criminologists. Based on modern requirements, as well as practical experience, we have studied the basics of forming evidence – perception, remembering and sharing facts and circumstances, which led us to the conclusion that the information and facts obtained during interrogation must be analyzed not only at the end of the interrogation but also during the interrogation itself.
