Abstract
The purpose of criminal proceedings is to protect the constitutional rights and freedoms of citizens. As well as the imposition, reduction or abolition of appropriate preventive measures for persons in conflict with criminal law, and so on. The paper, The Use of Detention in Criminal Proceedings under Foreign and Georgian Law, consists of three chapters. It should be noted that the detention of the accused must take into account the condition of the accused, in particular the health status of him and / or his family members, income, age of the accused and his family members, etc. However, regardless of his condition, if the purpose of the law cannot be achieved by applying a less severe measure of restraint, imprisonment will be applied to him. It should be noted that when filing a motion, the prosecutor must substantiate the issue of the expediency of the preventive measure.
