Abstract
The presumption of innocence is one of the main principles of the Georgian criminal process. We know it as: the presumption of innocence and freedom. Each representative and official of the State is obliged to protect it, to respect it, and to speak with measured, carefully selected words about the alleged guilt of others. Defending the presumption of innocence is mandatory for the media as well, but the state cannot be responsible for the actions of the media and cannot control every story or stature, as it will interfere with the independent media's editorial policy... That is why there are criminal sanctions imposed on any person for violating the presumption of innocence, and if the state does not do something, there are several international protection mechanisms that work very effectively and always stand by the oppressed. One such well-known mechanism is the European Court of Justice in Strasbourg, which protects the people of the Contracting States from other signatories to the European Convention for the Protection of Human Rights and Fundamental Freedoms.
