The Concept of Sexual Harassment and Prohibition of Hate Speech Anti-discrimination

Abstract
Based on the obligation of legal approximation of Georgian legislation with European law, the following research proposed for the academic society pays special attention to an overview of existing regulations on sexual harassment in EU law, analyses peculiarities of the institutional and legal framework of the fight against sexual harassment in European countries.
Additionally, an important place in the work is granted to the analysis of the legal guarantees and organizational mechanisms of the fight against sexual harassment in the USA, as a state with a valuable and ancient legal tradition in this field.
Dynamics of conceptual formation and legal recognition of sexual harassment, normative meaning of sexual harassment and qualifying legal prerequisites, allocation of the burden of proof, prohibitory sexual harassment policy models for universities as employers and Institutions of higher education, institutional and legal mechanisms operating in the workplace and educational space, procedural principles of disciplinary proceedings and guarantees are also widely-studied within the framework of research.
A substantive part of research is devoted to the issues of the definition of hate speech based on various international acts: a review of the Judicial practice of the European Court of Human Rights, an analysis of excerpts from those international acts that offer important definitions about hate speech.
