An agreement is an integral part of life of each person, and the main commitment of each party is to fulfill the conditions of the agreement properly and in good faith. However, despite willingness of the parties to perform obligations under the contract honestly, circumstances having a substantial effect on the performance of the obligation which could not be foreseen by the parties by the time of signing the contract may always arise.
The parties should negotiate the process of substantial change of circumstances and try to adapt the contract to these changes, as otherwise the obligation will not be performed and it can lead both parties to undesirable results. That is why the main aim of the institute of changed circumstances is that parties should provide the balance of interests and contractual equality of the parties, which serves to stabilize civil circulation.
In frames of the given masters degree work the effect of changes circumstances on the contractual relationships and the problematic issues of Georgian legislation connected with adaption of the contract will be reviwed with the ways of the issues according the example on Continental an Anglo-American law.
