Legal rights and obligations of parents and children (Comparative law analisis)

Abstract

In Georgian Legislation Family Law has one of the most important places. It has a huge role in public and state development. The family is the main cell of the society, the progress and success of the society depend on its’s firmness. Any civilized state takes care of the development and strengthening of family relations. Historically forms of family relations often have experienced changes and we reckon that they cannot be altered in the future. Masters’s work selected by us dedicates to family relations and rights and obligations of family members. In the work is consistently reviewed legal rights and obligations of family members, in particular, parent’s and childrens’s alimentary obligations. Parents’s rights and duties towards children and on the contrary the rights and duties of children towards parents, including adoptee, stepchild and chils born without marriage. In the final part of the Masters’s there are some opinions on the legal regulation of the rights and duties of parents and children. We believe that by using research methods we were able to partially focus on the important methods issues that are found in the real world of our lives.

საოჯახო სამართალს ერთ-ერთი მნიშვნელოვანი ადგილი უკავია ქართულ კანონმდებლობაში. დიდია მისი როლი საზოგადოებრივი და სახელმწიფოებრივი განვითარების საქმეში. ოჯახი არის საზოგადოების ძირითადი უჯრედი, მის სიმტკიცეზე ბევრად არის დამოკიდებული ქვეყნის წინსვლა და განვითარება. ოჯახური ურთიერთობების ფორმები ისტორიულად ხშირად განიცდიდა ცვლილებებს და ვფიქრობთ, რომ მათი შეცვლა არც მომავალშია გამორიცხული. ჩვენს მიერ შერჩეული სამაგისტრო ნაშრომი სწორედ ოჯახის წევრთა ურთიერთობებსა და უფლება-მოვალეობებს უკავშირდება. ნაშრომში თანმიმდევრულად არის განხილული მშობლების უფლება-მოვალეობები შვილების მიმართ და პირიქით შვილების უფლება-მოვალეობანი მშობლების მიმართ. ნაშრომში ასევე განხილულია ოჯახის სხვა წევრთა უფლებები და მოვალეობები, მშობლებისა და შვილების საალიმენტო ვალდებულებები, მათ შორის აყვანილი შვილის, გერისა და ქორწინების გარეშე დაბადებული ბავშვის. სამაგისტრო ნაშრომის დასკვნით ნაწილში კი წარმოდგენილია გარკვეული მოსაზრებები მშობლებსა და შვილებს შორის არსებულ უფლება-მოვალეობათა ზოგიერთ პრობლემურ საკითხზე. მიგვაჩნია, რომ კვლევითი მეთოდების გამოყენებით ნაწილობრივ მაინც შევძელით ყურადღება გაგვემახვილებინა იმ მნიშვნელოვან საკითხებზე, რომლებიც მრავლად გვხვდება ჩვენი ცხოვრების რეალურ სამყაროში.
