“Guardianship” and “custody” are one of the most important institutions in both Georgian and foreign civil law. These institutions are found in ancient times and include not only civil but also administrative norms.
As guardianship and caregiving are improving and changing daily, Depending on the topic's relevance and need, The master thesis deals with the comparative legal analysis of the Georgian and foreign legislation of the mentioned institutions.
With the said master's thesis consistently discusses the origin, essence, and significance of the Institute of Guardianship and Care, Rights and responsibilities of guardians and carers, guardianship and guardianship bodies and guardians and guardians of both Georgian and EU law regulations and case law.
The work also discusses the release of the guardian's caregiver from their duties and the grounds for termination of guardianship and custody. The final part of the master's thesis provides some insights into some of the problematic issues of guardianship and care.
Through the research methods used in the work, we have at least partially been able to focus on the important issues that are often encountered in today's reality.
