Abstract
The system of labour inspection is one of the most important mechanisms to protect labour rights. Internationally accepted standards in the labour inspection area indicate that certain labour conditions and protection of workers’ safety and health are inseparable components and the supervision of the full range provisions is the authority of the labour inspection. In accordance with the admitted international standard, the inspection mechanism mandate in the national context has to be relevant to the standards defined by ILO. In Georgia the labour inspection was established in 2015 and since then it has been operating through the state program on labour inspection, which provides its entitlement to access workplaces only by the prior consent of the employer and enables entity to release non-binding recommendations. Mentioned format of the labour inspection is not appropriate to the best practice and international standards. Inspection does not have such important powers as: to inspect the full spectrum of labour rights, visit the workplace without warning and prior permission of the employer and establish appropriate sanctions. Limited authorities of the labour inspection are inadequate to detect and eliminate the infringements of the labour legislation requirements, which has a negative impact on the quality of labour rights defence in the country.
