The Master Thesis deals with one of the most important and familiar issues of family law, such as divorce, its legal nature and consequences. More specifically, the study discusses the institution of divorce in private international law, its accompanying problematic issues and the ways to resolve them.
The divorce process is relatively complicated in a legal relationship laden with a foreign element, as it is regulated differently in the domestic law of a number of states and obviously leads to conflict of norms, delays in the process, non-recognition of decisions made by one state in another, which puts issues such as: Impossibility to determine the place of residence for the child, inadmissibility of the amount set for his/her support, alimony of the spouse (if necessary), violation of the right to receive half a share of the co-owned property, restriction of the right to remarry...
The thesis covers the practices and experiences of Georgia and different countries and offers ways to eliminate the gaps in our legislation. The purpose of the research is to discuss controversial issues and develop valid recommendations.
