People perform too many actions in their daily lives, and few of them observe the legal side of this action. This is one of the oldest institutions in civil law.
The paper analyzes the case law and the legal issues that raise questions about the practice of giving. That is why the issue of how orderly and perfect the norms of the Georgian Civil Code, which regulate the relationship between the giver and the giver, are, is on the agenda.
The paper discusses the legal nature of gifts, the necessary form for concluding a gift contract, the1 further relationship between the giver and the giver. The greed of the gifted person as a basis for the abolition of gifts, its procedural–legal issues, as well as the connection of the gift agreement with other branches of law. The Civil Code regulates these issues in several articles, which is not enough to regulate the legal relationship of gifts. This legislative framework needs to be refined and harmonized with regard to the German Civil Code. Therefore, we will touch on the legal problems of gifts and the essence of gifts in the chapters below.
