The presented master’s thesis discussis the breach of obligation as a basis for termination of the employment contract during the legal employment relationship, the discussion of which was conditioned by the existing reality.
The main issue to be discussed in the paper is the direct breach of the obligation, on the basis of which the employee is fired. The cause for termination of this employment relationship can be made only if it is grossly violated. Gross breach of obligation is the subject of evaluation and requires individual consideration in each specific case.
The presented paper analyses both international and Georgian scientific literature, court practice, which clearly show us the labor legislation and the problems in the labor market.
The objective of the paper is to create appropriate guarantees for the protection of the employee’s interests as a weak side, which is a rather problematic issue in the current situation. Despite the changes in the legislation, many norms are still vague and need to be specified.
