სასჯელის მოხდისაგან გათავისუფლების პრობლემები თანამედროვე ქართულ სამართალში

The present paper concerns the problem of exemption from serving a sentence, which is one of the most difficult institutions in Georgian modern law, taking into account its social and legal peculiarities. The paper includes some interesting and at the same time some exceptional views on the use of legal mechanisms to exempt from serving a sentence, as well as the normative approaches related to the regulation of the issue, based on in-depth analysis of practice and research of few scientific papers.
Accordingly, the paper represents a complex set of basic, scrupulous provisions, and the national level approaches are compared to internationally known models, on the basis of which a comparative analysis is performed. Related to this are made the proposals of a recommendatory nature in order to improve the regulation of legal relations.
In order for research to be valuable and important, the paper is based on research methods that can be used to analyze the functioning of a given institution, criminological assessment of the risk factors associated with it, and determining how well the goals of punishment have been achieved when using them.
The concept also focuses on how a complex approach is applied individually to each convict, whether the condition of the support person(s) is taken into account, that, on the one hand, must provide a guarantee of stability, that the convict does not commit an unlawful and criminal act or attempt to commit a crime.
