Abstract
The work is topical as far as there are many unresolved issues regarding the legal qualification of bribes. The work deals with two crimes, bribe giving/bribe taking, as a primary manifestation of corruption in young democracy countries. In practice, the Prosecutor's Office may prosecute the bribery case, but the court canre-validate during the process. According to the signs, bribe giving/bribe taking has neighboring crimes and in each case, the court is facing a dilemma when qualifying, therefore, the main issue of the paper is the problem of the legal qualification of the bribe by substantiating the article and the related crimes as well. Work includes the detailed review of the bribe qualification, the legal judgement and argumentation and all the aspects that arise around the issue.
