Current legal issues of the servitude

Property law and its institutions have always been popular subjects of the civil law, in its essence, the nature, content and practical application of the above, especially of such institutions, Which were developed and introduced from the foreign law last century, as in the Soviet period its existence in the codification was either necessary.
This paper discusses the legal property of the Institute - the essence of the easement and proprietary rights in comparative legal analysis of the country's domestic law, and in Europe, mainly in Germany and Switzerland-based norms.
The paper discusses the problems of legal regulation and recommendations, and based on the other countries' legal systems of law and on the analysis of Georgian law .
All of the above mentioned, it is necessary and actual to study the specification of servitude, establishment of legal nature and revision of legal content.
