The aim of the presented thesis is to analyze such a topical and problematic issue as the definition of an international standard and minimum guarantees for the participation of an abusive accused in criminal proceedings. For the purposes of the research, will be largely reviewed, the important components of a fair trial that limit the mentally ill accused, for example, the right to effective participafion in the hearing, participate in a jury trial, right to defense, the importance of communication between defendant and barrister and connection with other criminal law principles, a fiar trial generally.
Depending on the purpose of the research subject in addition to various literature and articles, the case law of the European Court of Human Rights is widely used, because of its meaning as a interpretator of the rights enshrined in the European Convention on Human rights and for development of nation law according to its case law.
