In today's world bank guarantee, which has an important place among various economic activities, is one of the forms of banking service. In fact, it became an integral part of the society, in which financial obligations and means of settlement are considered.
This Master’s Work covers the essence of bank guarantee and the sphere of its influence on commercial relations. The main stages of its origin and development are presented. The independent nature of bank guarantee in legal space is defined. The general and distinguishing marks of Georgia and other leading countries are studied in connection with this issue, especially focus on uniqued rules and comparative analysis is made based on this.
There are clearly explained main types of the bank guarantee and characteristics of each of them thatgives us the possibility to separate them from each other. There are underlined all the problems of functioning of bank guarantees in the scope of national legislation. Also, the boundaries of releasing form the responsibility are given.
The role of the bank guarantees and the wide range of their actions are considered, namely: rights, obligations, and interrelations, on which they are based. The precedent decisions taken on bank guarantee are indicated and recommendations for legally correct regulation of bank guarantees are reflected.
