Abstract
The master's thesis analyzes the definition of the legislation of different countries of the world at the scientific level, in the context of the concept of a criminal liability of legal entity. The topic examines in detail the problems of legal entity's criminal liability in the reality of both highly developed countries and Georgia. The paper discusses the similarities and differences between the Georgian legal model and the legal models of other countries within the legal framework for legal entities.
Due to the fact that the criminal problems of a legal entity cannot be separated from the subject of discussion, the topic analyzes Article 24 of the Civil Code of Georgia, which in turn provides an explanation of the legal entity. This definition is in some cases insufficient to describe self-portraits of legal entities at the legislative level. In presenting the scientific explanations of the legal entity, which are explained in detail in the first paragraph of the current removal, mention is made of the circumstance that legal entities are divided into private and public legal entities. The fundamental circumstance of creation that exists when creating legal entities under private law is that they are created in an environment with equal rights in which the principle of free will applies. The legal entities of private law are divided into two different groups and their sorting in these groups is determined by their activities. The master's thesis also refers to the circumstance that a legal entity as a legal entity was included in the Criminal Code of Georgia a few years ago and the problems related to it still exist. Due to the tendencies of international law, there is often an opinion in Georgian legal systems that establishes the principle that only the prerogative of civil law is to consider the responsibility of a legal entity.
Due to the existence of such opinions, it is often quite difficult to deal with the problem that arises when the legal entity's responsibility is determined by the criminal law norms instead of the civil law norms. Since the liability of a legal entity may go beyond the scope of civil law reasoning, in this case the question of its criminal liability arises. There are mixed opinions about the criminal liability of a legal entity in different countries of the world and the problems related to it. The current situation in Georgia's legal reality makes it difficult for us to be a member of the world's leading countries.
