This thesis reviews surety and bank guarantee as means of demand collateral. Here are discussed the regulating norms for these two institutions and the essential diffences between them are established. Futhermore, court practice related to surety and bank guarantee is discussed as well.
The thesis consists of introduction, three chapters, conclusion and references.
The first chapter includes the discussion of the literature about surety and bank guarantee.
The second chapter discusses regulating norms of surety and bank guarantee in Georgian legislation, the legal nature of the origin documents for them, legal status and rights and duties of subjects and other engaged parties. In addition, this chapter includes discussion of problems related to legislation and court practice.
Reasearch results, derived from the contents of issues discussed in the second chapter, are included in the third chapter. Besides, the problematic question covered by this thesis is established.
