Present scientific paper analyses the plenary power of the State and local Self-Government in the sphere of property use and management. After the Restoration of State Independence of Georgia, certain changes in regards of state power decentralization were implemented, which mostly had contradictory directions. However, since 2004, when Georgia signed the European Charter of Local Self-Government, the country has got the obligation to provide effectual steps and the process of decentralization of power has been framed, but reforms towards this topic happen extremely slowly. It is hard for the State to manage any industry without clearly defining the property, which in general is monopolized by the State and it is essential to implement the number of reforms clearly defining the distribution of competences connected with the property of the State and Self-Government.
The aim of this scientific paper is to outline any flaws which exist in the property management of the State and Self-Governments, investigate the degree of property independence and grounds of plenary power separation, principles and criteria. Author supports the reform of complex property decentralization, which will create real institutional guarantees for Municipalities to be independent and decide subjects of local matter with clearly defined property and the plenary power provided to it, unhindered implementation without the intervention of the State.
