The Master's Thesis is dedicated to the role of a lawyer in the Criminal Procedure Code. The Criminal Procedure Code of Georgia 2009 is based on equality of arms and adversarial, which increased the role of the lawyer in criminal proceedings.
Despite the new regulations there are many problems in legislation and investigative judicial practice, which challenges the principle of equality and adversarity. The existence of this problem has led to the selection of this topic and the relevant research.
The work deals with the function of the lawyer's meaning and the legal status, right to legal assistance and peculiarities of equality and adversarial principle. Particular attention is paid to the lawyer's authority and the role of the lawyer at the investigation stage. Namely restricted advocacy and traditional investigation, the procedural situation of the lawyer at the stage of investigation and in conducting investigative action, lawyer's constitutional guarantees.
