Settlement of owners' rights at mortgage demand

Master's thesis is related to one of the most pressing institutions of civil law, namely mortgage. More specifically, the work deals with owner rights in mortgage.
The actuality of the topic of the master's thesis is due to the mortgage. In practice everyday is used by the regulatory legal norms of this institution. If we delve into their content, we will clearly see the shortcomings that are allowed in the legislation. Thus, it is necessary to study the issue deeply, find problematic issues, eradicate them and make relevant changes in the legislation in order not to endanger the rights guaranteed by the Constitution of the people.
The work deals with the problematic issues related to mortgage and owner rights. The research aims to demonstrate the shortcomings in the Georgian legislation regarding the regulatory norms of the legal relations.
The work analyzes the role of mortgage and what is the position of this regulatory norms in the system of regulating civil-legal relations. It is also demonstrated that the importance of defining the rights and obligations of the parties to the relevant legal relations is important.
As a result of the research, the means of regulating the existing legal problems are discussed and the recommendations that are based on the study and analysis of the law.
