Abstract: | წინამდებარე ნაშრომში განხილულია შეჯიბრებითობისა და თანასწორობის არსი სისხლის სამართლის პროცესში. ჩამოყალიბებულია ცნება და მისი მნიშვნელობა სწორი მართლმსაჯულების განხორციელებისათვის. წარმოდგენილია სისხლის სამართლის პროცესის ფორმების განვითარების მოკლე ისტორია, რომელიც საშუალებას იძლევა თითოეულ მათგანზე დაკვირვებით გამოიკვეთოს ის ერთი, რომელიც ყველაზე მეტად მიესადაგება დღევანდელ რეალობას. ნაშრომში ყურადღება ეთმობა საგამოძიებო მოქმედებების დროს მხარეთა უფლება-მოვალეობებს, რეალიზების პრობლემებსა და სასამართლოს როლს შეჯიბრებით სამართალწარმოებაში. ეროვნულთან ერთად, ასევე განხილულია ანგლო-ამერიკული და კონტინენტური ევროპის სამართლის სისტემების კანონმდებლობა, შეჯიბრებითობისა და თანასწორობის პრინციპის რეალიზაციის კუთხით. სისხლის სამართლის პროცესში განხორციელებული მნიშვნელოვანი ცვლილებების შემდეგ, როგორიც იყო, ინკვიზიციური პროცესიდან შეჯიბრებითზე გადასვლა, ქართულ სისხლის სამართლებრივ რეალობაში დამკვიდრდა სრულიად ახალი მოდელი. პროცესის შეჯიბრებითობისა და თანასწორობის პრინციპზე აგება გულისხმობს იმას, რომ საქმის ბედი დამოკიდებულია მხარეთა მომზადებასა და აქტიურობაზე, სადაც მოსამართლე პასიურ როლშია. ნაშრომში წარმოდგენილი საკითხების ანალიზი ცხადყოფს, რომ საქმის წარმოებისას მხარეები არათანაბარ მდგომარეობაში იმყოფებიან, მაშინ, როცა სწორი მართლმსაჯულების განხორციელებისათვის, შეჯიბრებითი სამართალწარმოების პირობებში, აუცილებელია მხარეებს გააჩნდეთ თანაბარი შესაძლებლობები, ჩაატარონ საგამოძიებო მოქმედებები, მოიპოვონ საჭირო მტკიცებულებები და გავლენა მოახდინონ საქმის საბოლოო შედეგზე. მიუხედავად თანასწორობის უფლების მნიშვნელობისა, ის მაინც არ გულისხმობს მხარეების სრულ გათანაბრებას, არამედ მათთვის ისეთი თანაბარი შესაძლებლობების მინიჭებას, სადაც არცერთი მხარე არ აღმოჩნდება არსებითად არახელსაყრელ მდგომარეობაში. ყოველივეს დაწვრილებით ქვემოთ მოცემულ თავებში გავეცნობით. The given paper discusses the essence of adversarial and parity in criminal proceedings. The concept and its meaning for the implementation of proper justice have been determined. A brief history of the development of forms of criminal proceedings is presented, which allows to identify the one that is most appropriate to today’s reality through the observation of each of them. The paper focuses on the rights and obligations of the Parties during the investigative actions, the problems of fulfilment and the role of the court in the adversarial legal proceedings. In addition to the national system, the legislation of the Anglo-American and Continental European legal systems has been also discussed, in terms of the implementation of the principle of adversarial and parity. After significant changes in the judicial proceedings, such as the transition from the judicial inquisition process to the adversarial process, a completely new model has been established in the Georgian judicial reality. Being based on the principle of adversarial proceedings and parity means that the fate of the case depends on the activity of the Parties – the process will be succeeded by those who have better evidence and are better prepared. The analysis of the issues presented in the paper demonstrates that the Parties are in an unequal position during the proceedings, while in order to carry out due process in the adversarial judicial process, it is necessary for the Parties to have equal opportunities to conduct investigative actions, acquire the necessary evidence and have effect on the final outcome of the case. Despite the significance of the right to parity, it still does not imply complete equality of the Parties, but rather the granting of equal opportunities to them, where neither Party finds itself in a substantially unfavourable position. We will learn more in the chapters below. |
