ეთიკა და ქცევის ზოგადი წესები საჯარო სამსახურში: მისი დაცვის უახლესი ტენდენციები

Abstract

The mentioned Master's Thesis"Ethics and General Rules of Behavior in Public Service and Latest Trends for its Protection",concernstopical problem of public service andextremely large-scale in Georgian reality - the necessity of protection of ethical norms in the process of implementing authority by public officials, also further improvement, necessity and identification of the existing protection mechanisms. The aim of the researchwas to study actual problems related to ethics of public service in Georgian public space, finding ways to solve them as a result of a thorough analysis of existing practice, our aim was to describe available condition in the public sector in transition epoch, analyze changes in existing legislation, which makes the research more actual. The task of a conducted research is to develop specific proposals, opinions and recommendations,which realization will help to increase the knowledge of the ethical aspects of public officer’s behavior, to increase the effectiveness of the acting administrative or legislative mechanism. The subject of the researchare defining aspects of human behaviorwith ethical behavior regulations,The object of the researchis to analyze the legal regulations that define the activities of public institutions relevant to the legislative basisregulating Georgian legislative service. As a main result we prove that, despite the many cardinal reforms in the public sector, the shortcomings and challenges still remain, especially noteworthyis the ethical nature problems in public service.The novelty of this research is that,problems existing in public service in this regard and legal mechanisms of its regulation have been studied.The recommendations proposed in the research and adaptation of their individual components will help to increase and develop the effectiveness of the public service.

აღნიშნული სამაგისტრო ნაშრომი,,ეთიკა და ქცევის ზოგადი წესები საჯარო სამსახურში და მისი დაცვის უახლესი ტენდენციები", ეხება საჯარო სამსახურის აქტუალურ და ქართულ რეალობაში მეტად ფართომაშტაბიან პრობლემატიკას-საჯარო მოხელეთა მიერ უფლებამოსილების გაბხორციელების პროცესში ეთიკური ნორმების დაცის აუცილებლობას, აგრეთვე არსებული დაცვის მექანიზმების შემდგომ გაუმჯობესებას,აუცილებლობასა და შესაბამისი მიმართულებით იდენტიფიკაციას. კვლევის მიზანი გახლავთ შეგვესწავლა ქართულ საჯარო სივრცეში საჯარო სამსაურის ეთიკასთან დაკავშირებული აქტუალური პრობლემები, არსებული პრაქტიკის საფუძვლიანი ანალიზის შედეგად მათი გადაჭრის გზების მოძიება, ჩვენი მიზანი გახლდათ აგვეღწერა საჯარო სექტორში არსებული მდგომარეობა გარდამავალ ეპოქაში, ჩაგვეტარებინა არსებული კანონმდებლობის ცვლილებების ანალიზი, რაც საკვლევ თემას აქტუალურ ხდის.ჩატარებული კვლევის ამოცანაა კონკრეტული წინადადებების, მოსაზრებების და რეკომენდაციების შემუშავება, რომელთა რეალიზება დაეხმარება საჯარო მოხელის ქცევის ეთიკური ასპექტების ცოდნის ამაღლებას,მოქმედი ადმინისტრაციული თუ საკანონმდებლო მექანიზმის ეფექტურობის გაზრდას, კვლევის საგანი ეთიკური ქცევის რეგულაციებთან ეთად აგრეთვე არის ადამიანის ქცევის განმსაზღვრელი ასპექტები. კვლევის ობიექტი ქართული საკანონმდებლო სამსახურის მარეგულირებელი საკანონმდებლო ბაზის შესაბამისი საჯარო ინსტიტუტების საქმიანობის განმსაზღვრელი იურიდიული რეგულაციების ანალიზი, ძირითად შედეგად ვამტკიცებთ იმას, რომ მიუხედავად არაერთი კარდინალური რეფორმებისა საჯარო სექტორში კვლავ რჩება ხარვეზები და გამოწვევები, განსაკუთრებით საყურადღებოა საჯარო სამსახურში ეთიკური ხასიათის პრობლემები.
