ჭიღლაშვილი, ლიაინაური, ჟანაჟანაინაურიInauri, ZhanaZhanaInauri2022-02-022022-02-022021https://openscience.ge/handle/1/2854მშობლებისა და შვილების უფლება-მოვალეობების შესწავლა საოჯახო სამართლის ერთ-ერთ მნიშვნელოვან ინსტიტუტს წარმოადგენს. საკანონმდებლო დონეზე აღნიშნული საკითხები რეგულირდება საქართველოს სამოქალაქო კოდექსით, ბავშვთა უფლებების შესახებ კონვენციითა და ბავშვის უფლებათა კოდექსით, რომელიც საკანონმდებლო სიახლეს წარმოადგენს, ბავშვის მიმართ მშობლის უფლება-მოვალეობების ჭრილში. მშობლებსა და შვილებს შორის არსებული პირადი არაქონებრივი და ქონებრივი უფლება-მოვალეობები, ამ ურთიერთობის სუბიექტების ბუნებიდან გამომდინარე აქტუალურია თანამედროვე ეპოქაშიც. ამ სფეროდან გამომდინარე სადავო საკითხებიც, ხშირ შემთხვევაში, სასამართლოს განსჯადია, რაც უდავოდ მიუთითებს მის მნიშვნელობაზე. კანონმდებლობით შეუძლებელია ამომწურავად დარეგულირდეს ზემოაღნიშნული ურთიერთობები, განსაკუთრებით ყურადსაღებია მშობლებისა და შვილების ურთიერთუფლებამოვალეობების საკითხის შესწავლა სასამართლო გადაწყვეტილების, როგორც კანონმდებლობის შემავსებელი ინსტრუმენტის ანალიზის საფუძველზე.The study of the rights and responsibilities of parents and children is one of the most important institutions of family law. At the legislative level of Georgia, these issues are regulated by the Civil Code of Georgia, the Convention on the Rights of the Child, Law of Georgia the Code on the rights of the Child. We should mention that the last one is a novelty also in terms of parental rights and responsibilities towards the child. Personal non-property and property rights and responsibilities between parents and children, due to the specifications of the parties of this relationship, are actual and up-to-date in the modern era as well. The fact that disputes arising in this field are often heard in court undoubtedly indicates the importance of the issue. The above-mentioned relations cannot be exhaustively regulated by the legislation.
