განრიდება და მედიაცია ქართულ სისხლის სამართალში

Abstract

The master's thesis is dedicated to "Diversion and Mediation in the Georgian Сriminal Law" The work deals with issues that are more relevant, problematic and interesting. The main purpose of the work is its novelty, the actuality is also justified in Georgian legislation. It is noteworthy that this program is very popular not only in Georgia but also in many leading countries of the world Discussion and mediation, principles of diversion and mediation, diversion and mediation process, also discussed what is the diversion of juveniles which is the most current and problematic issue in recent times, and the topics discussed underlined issues I'm moving out mediation and both the positive and negative sides. The Georgian legislation is used in the topic and compared with the German legislation to understand the difference and the relationship between this two countries in particular. The master's thesis consists of an introduction, a summary of literature, three chapters, subheadings and conclusions. It also contains the information in the form of annexes where statistics are available. The list contains the list of used literature and includes a total of 62 pages on Tabakh.

წარმოადგენს მისი სიახლე, აქტუალურობა ასევე რამდენად გამართლებულია ქართულ კანონმდებლობაში. აღსანიშნავია ის გარემოებაც რომ აღნიშნული პროგრამა დიდი პოპულარულობით სარგებლობს არამარტო საქართველოში არამედ მსოფლიოს მრავალ წამყვან ქვეყანაშიც. თემაში განხილული გვაქვს თუ რას ნიშნავს განრიდება და მედიაცია, ასევე განრიდების და მედიაციის პრინციპები, განრიდების და მედიაციის ღნისძიებები, განრიდების და მედიაციის პროცესი, ასევე განხილული გვაქვს თუ რა არის არასრულწლოვანთა განრიდება რომელიც ბოლო დროის ყველზე აქტუალური და პრობლემატური საკითხია, ასევე თემაში განხილულია ისეთი საკითხები რომლებიც ხაზს უსვამს განრიდების და მედიაციის როგორც დადებით, ასევე უარყოფით მხარეებს. თემაში გამოყენებული და შედარებულია ქართული კანონმდებლობა გერმანულ კანონმდებლობასთან იმისათვის რომ კარგად გავიგოთ რა განსხვავება და საერთოა ამ ორ ქვეყანას შორის კონკრეტულად ამ თემასთნ მიმართებით. სამაგისტრო ნაშრომი შედგება შესავალის, ლიტერატურის მოკლე მიმოხილვის, სამი თავის, ქვეთავებისა და დასკვნისაგან. ასევე თემას ახლავს დანართების სახით ინფორმაცია სადაც მოცცემულია სტატისტიკური მონაცემები. თემას ერთვის გამოყენებული ლიტერატურის ნუსხა და მთლიანობაში მოიცავს თაბახზე ნაბეჭდ 62 გვერდს.
