დამნაშავის შეპყრობის მართლზომიერების პირობების დასაბუთების გზა და მათი პრობლემები

Abstract

დამნაშავის შეპყრობა ქართულ სისხლის სამართლის კანონმდებლობაში სიახლეს არ წარმოადგენს. დამნაშავის შეპყრობის ინსტიტუტის ქართულ სისხლის სამართლის კანონმდებლობაში შემოტანის შესახებ საკითხი პირველად დასვა პროფესორმა თ. შაგულიძემ გასული საუკუნის 80-იან წლებში. ნაშრომში მოცემულია დამნაშავის შეპყრობის ცნება, მისი მართლზომიერების ფარგლები, მართლზომიერების ფარგლების გადამეტება და ამ ინსტიტუტთან დაკავშირებული სხვა პრობლემებია გადაწყვეტილი. ნაშრომი დახმარებას გაუწევს ამ საკითხით დაინტერესებულ ყველა პირს.

The issue of arresting a criminal is not a novelty in Georgian criminal law. Professor T Shavgulidze was the first who arose a question of including the questions connected with arresting a criminal in Georgian criminal law in the 80s of the 20th century. The thesis covers the issues such as the concept of arresting a criminal, staying within the bounds of law and going beyond the bounds of moderation while arresting a criminal and it also suggests solutions of the problems connected with this issue. The thesis will be helpful for everyone who is interested in this question.
