Abstract

The presented paper "Substantive Evidence in Criminal Proceedings" consists of an introduction, a review of the literature, four chapters and a conclusion. The first chapter of the paper discusses the historical aspects of the use of material objects as evidence in Georgia and abroad. Note that obtaining, evaluating, and correcting material evidence leads to the conduct of the investigation and subsequent decision-making by the court. In the second chapter of the paper, the notion, types and classification of material evidence in criminal proceedings, the notion and types of material evidence, the weapon of crime, the subject of the criminal act, the traces left as a result of the crime are discussed. The same chapter discusses the classification of evidence. The division of material evidence into types, as well as their classification, is of great theoretical and practical importance, which is why it is important to research and analyze the issue. In the next chapter, the means of assembling material objects in criminal proceedings, discuss the features of search, removal, and inspection. The same chapter discusses the expertise and the importance of the expert's conclusion. This action is taken when it is necessary to find material evidence or trace the crime. The fourth chapter of the paper discusses the peculiarities of assessing material evidence and determining fate, noting that one of the most responsible and difficult processes is the process of proving and evaluating evidence, as this process is associated with certain difficulties. წარმოდგენილი ნაშრომი „ნივთიერი მტკიცებულებები სისხლის სამართალწარმოებაში“ შედგება შესავალის, ლიტერატურის მიმოხილვის, ოთხი თავისა და დასკვნისაგან. ნაშრომის პირველ თავში განხილულია ნივთიერი ობიექტების მტკიცებულებად გამოყენების ისტორიული ასპექტები საქართველოში და საზღვარგარეთის ქვეყნებში. აღსანიშნავია, რომ ნივთიერი მტკიცებულებების მოპოვება, შეფასება და სწორი ანალიზი განაპირობებს გამოძიების სწორედ წარმართვასა და შემდგომ, სასამართლოს მიერ დასაბუთებული გადაწყვეტილების მიღებას. ნაშრომის მეორე თავში - ნივთიერი მტკიცებულების ცნება, სახეები და კლასიფიკაცია სისხლის სამართლის პროცესში, განხილულია ნივთიერი მტკიცებულებების ცნება და მისი ცალკეული სახეები - დანაშულის იარაღი, დანაშაულებრივი ქმედების საგანი, დანაშაულის შედეგად დატოვებული კვალი. ამავე თავშია მოცემულია მტკიცებულებათა კლასიფიკაცია. შემდეგ თავში - ნივთიერი ობიექტების შეკრების საშუალებები სისხლის სამართალწარმოებაში, განხილულია ჩხრეკის, ამოღებისა და დათვალიერების თავისებურებები. ამავე თავშია განხილულია ექსპერტიზა და ექსპერტის დასკვნის მნიშვნელობა. აღნიშნული საპროცესო მოქმედება ხორციელდება მაშინ, როდესაც ნივთიერ მტკიცებულებათა გამოკვლევაა საჭირო. ნაშრომის მეოთხე თავში კი განხილულია ნივთიერი მტკიცებულებების შეფასებისა და ბედის განსაზღვრის თავისებურებები. სამაგისტრო ნაშრომი სრულდება დასკვნით
